OFFICIAL RULES

This “Weekend Away” is sponsored by Julian’s Cheesecakes, Inc. d/b/a Finagle A Bagel (hereinafter, “Finagle” or the “Sponsor”). Participating Finagle stores have entry blanks. Each individual must provide legibly handwritten or typed entry forms. Participants may use supplied entry forms or send their name, address, e-mail address, day-time phone number and favorite type of Moosewood soup to 77 Rowe Street, Auburndale, MA 02466 c/o Moosewood Soup Giveaway. NO PURCHASE NECESSARY TO ENTER. Participants must supply their full address, email address and telephone number with their entry submission. All entries must be complete to be eligible.

All mailed entries must be sent by first class mail and postmarked by January 30, 2008. All in-store entries must be placed in the stores’ “Moosewood Weekend Giveaway” box by store closing on January 30, 2008. Limit: ONE (1) ENTRY PER PARTCIPANT. All entries will be considered in the same manner, regardless of method of entry. All submissions, including the winning entry, will be the property of Finagle, and the Winner shall have no rights of ownership or entitlement to compensation other than provided for below. Winners will be notified by phone. One winner will receive a trip to Ithaca New York. The trip to Ithaca will include accommodations (for 2 people): 2 nights at the Henry William Miller Inn, 2 complimentary meals (lunch or dinner), $200.00 travel stipend, and assorted gifts from Moosewood. Trip does not include travel to and from Ithaca. 50 other winners will receive one copy each of the Moosewood Cookbook entitled “Simple Suppers.” No substitutions will be allowed and prizes may not be redeemed for cash or other consideration.

Participants must be 18 years of age or older. Finagle employees and their relatives are ineligible to enter the Giveaway and/or win any prizes. Winners may be required to sign an affidavit of eligibility and must consent to use of their names and likenesses for publicity purposes without additional compensation. All federal, state, local and other taxes, where applicable, are the sole responsibility of the winners. Finagle shall resolve any dispute regarding the Moosewood Weekend Giveaway or these Official Rules in its sole and final discretion. THIS GIVEAWAY IS VOID WHERE PROHIBITED.

By entering this Giveaway, each participant agrees to be bound by these Official Rules and the decisions of the Sponsor, which shall be final. BY ENTERING, PARTICIPANTS RELEASE AND HOLD HARMLESS THE SPONSOR, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR ANY DAMAGES, LOSS OR INJURY OF ANY KIND ARISING FROM OR IN CONNECTION WITH THE GIVEAWAY OR ANY PRIZE WON. The Sponsor will be collecting personal data about you for the administration of the Giveaway and for purposes necessary for market research. No such personal data will be transferred or sold to any third party. The data will be kept on secure data storage systems in Newton, accessible only by the Sponsor. Any requests for access to the information you have supplied, or to update or rectify it, may be submitted in writing to the Sponsor. All Giveaway entries become the property of the Sponsor, and none will be returned.

The Sponsor, agents and representatives of the Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible, or postage-due entries; (ii) any computer system, phone line, hardware, software or program malfunction or other errors, failures or delays in computer transmission or network connections; (iii) any condition caused by events beyond the control of the Sponsor that may cause the Giveaway to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Giveaway; or (v) any printing or typographical errors in any materials associated with the Giveaway.

By participating in the giveaway, each participant agrees to release and hold the Sponsor and the employees, officers, directors, shareholders, agents, representatives of the Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Giveaway or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. The Sponsor is not responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway, regardless of whether the material was prepared by the Sponsor or a third party.

THE SPONSOR RESERVES THE RIGHT TO CANCEL OR MODIFY THE GIVEAWAY IF FRAUD, TECHNICAL PROBLEMS, OR ANY OTHER FACTOR BEYOND THE SPONSOR'S REASONABLE CONTROL CORRUPTS THE ADMINISTRATION, SECURITY OR PROPER PLAY OF THE GIVEAWAY OR IN ANY WAY IMPAIRS THE INTEGRITY OF THE GIVEAWAY AS DETERMINED BY THE SPONSOR IN ITS SOLE DISCRETION. IN THE EVENT OF SUCH IMPAIRMENT, THE SPONSOR RESERVES THE RIGHT BUT HAS NO OBLIGATION TO SELECT WINNERS AT RANDOM FROM ALL REGISTERED ENTRANTS AT THE TIME OF SUCH IMPAIRMENT, AS DETERMINED BY THE SPONSOR.
